Business Policies All orders are subject to our full terms and conditions outlined below. It’s important to note that nothing in these conditions affects your statutory rights as a consumer.
Standard Conditions of Sale
- Definitions
1.1 “Buyer” refers to the person purchasing or agreeing to buy the Products from the Seller.
1.2 “Conditions” pertain to the terms and conditions of sale outlined in this document, along with any special terms agreed upon in writing by the Seller.
1.3 “Delivery date” signifies the date specified by the Seller for the delivery of Products.
1.4 “Products” encompasses the specified goods.
1.5 “Price” refers to the cost of the Products, inclusive of carriage, packing, and VAT.
1.6 “Seller” denotes PlushFurniture (plushfurniture.co.uk).
1.7 “Consumer” holds the meaning ascribed in section 12 Unfair Contract Terms Act 1977.
- Conditions Applicable
2.1 These conditions do not impede the buyer’s statutory rights as a consumer.
2.2 The contract is formed based on the Seller’s written quotation accepted by the Buyer or any written or verbal order accepted by the Seller. These conditions govern the contract, excluding any other terms and conditions, whether accepted or purported to be accepted by the Buyer.
2.3 Any errors or omissions in sales literature, quotations, price lists, or other documents issued by the Seller are subject to correction without liability on the Seller’s part.
2.4 If any provision of these conditions is deemed invalid or unenforceable, it shall not affect the validity of other provisions.
2.5 In cases where the Seller lacks sufficient stock to fulfill the order, any payment made by the Buyer will be promptly refunded. The Seller will not be obliged to offer compensation for disappointment suffered.
- The Price and Payment
3.1 The Price is as stipulated in the Seller’s current published price list at the order date. The Seller may increase the Price due to factors such as increased costs or taxes, and the Buyer has the right to cancel the order upon written notice.
3.2 Payment is due at the order date, and time for payment is essential. Failure to pay may result in the Seller taking action for the Price.
- The Products
4.1 The quantity and description of the Products are outlined in the Seller’s quotation.
4.2 The Seller may make changes to the Products’ specification that do not materially affect quality or performance, ensuring compliance with statutory requirements.
4.3 Photographs are illustrative and may not precisely match the product.
4.4 All upholstered products are made-to-order, bespoke to your specifications.
- Warranties and Liability
5.1 Goods come with a manufacturer’s warranty of at least 12 months.
5.2 The Seller provides information for claiming under the manufacturer’s warranties. Claims should be directed to the Seller’s customer service department.
5.3 The Seller does not provide warranty cover against defects.
5.4 Except for Consumers, all other warranties, conditions, and terms related to fitness for purpose, satisfactory quality, or product conditions are excluded to the fullest extent of the law.
5.5 The Seller’s liability is limited to, at its discretion, rectifying shortages or non-delivery, replacing or repairing defective goods, or refunding the sum paid for the goods.
- Delivery, Returns, and Cancellations
6.1 Delivery will be made to the Buyer’s specified location. The Seller aims to meet agreed delivery dates, with time not being of the essence.
6.2 The Seller is not liable for any delay in delivery, and risk passes to the Buyer upon delivery.
6.3 Additional charges may apply for specific delivery locations, and these will be communicated before order confirmation.
6.4 The seller will not issue full refunds for any made to order items. The seller will refund the purchase price, excluding administration fee of 50% per order if the order is not cancelled within 24 hours. The seller will process your refund as soon as the item is received back in stock. Orders that have not been delivered will be refunded within 14 days of notification.
6.5 For made to order items that have been delivered and returned will be refunded within 14 working days after we receive your return. The seller will refund 50% of your purchase price, excluding collection and restocking charge of £99 per order.
6.6 For returns within fourteen days of delivery, the Buyer can arrange return at their cost or request collection from the Seller at a minimum cost, deducted from the refund.
6.7 Goods must be returned in their original condition and packaging. The Seller reserves the right to withhold part of the refund for damaged items.
6.8 Mattresses can only be returned if unopened. Once opened and slept on, mattresses cannot be returned.
6.9 Any none made to order items (car beds, lamps) will be issued with a full refund providing the items are returned in their existing unopened packaging. The buyer will be liable to return costs.
6.10 The Seller may deliver on public holidays.
- Acceptance of the Products
7.1 The Buyer is deemed to have accepted the Products immediately upon delivery.
7.2 After acceptance, the Buyer cannot reject Products not conforming to the contract.
- Title and Risk
8.1 Risk passes to the Buyer upon delivery, while title remains with the Seller until full payment is received.
8.2 The Buyer cannot pledge or charge Products still owned by the Seller, and any such action makes all due payments immediately payable.
- Insolvency of Buyer
9.1 In case of the Buyer’s insolvency, the Seller reserves the right to cancel the contract or suspend deliveries without liability. The Price becomes due and payable immediately.
- General
10.1 Neither party is liable for delays caused by events beyond their control.
10.2 Notices must be in writing and sent to the respective addresses provided.
- Headings
11.1 Headings in these conditions are for reference only and do not affect the construction of these conditions.
- Representations
12.1 No statement or recommendation by the Seller’s agents or employees enlarges, varies, or overrides these conditions.
- Additional Costs
13.1 The Buyer agrees to pay for any loss or extra cost incurred due to instructions, lack of instructions, failure to take delivery, or acts/default of the Buyer.
- Proper Law of Contract
14.1 This contract is governed by the laws of England and Wales. Any disputes are determined exclusively by the Courts of England and Wales.

We get all your fabrics and materials needed to start building your bed and then start to handcraft your perfect bed.
Delivery and assembly
Once your bed is ready, we will contact you to arrange delivery and assemble your bed if you have selected this option.
